1. Scope
These Terms and Conditions (“T&Cs”) apply to all orders placed via our online shop Forty Four Sneaker. Our online shop is intended exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that predominantly are outside that person’s trade, business or profession.
An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their trade, business or profession.
We deliver to customers in Germany and internationally.
2. Contract Partner, Conclusion of the Contract, and Correction Options
The purchase contract is concluded with Forty Four Sneaker.
By placing products in our online shop, we make a binding offer to conclude a contract. You may place products in the shopping cart without obligation and correct your entries at any time before submitting your binding order.
A contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking the “Buy now” button.
3. Contract Language and Data Storage
The contract languages are German and English.
Order data is stored automatically and can be accessed by you by logging into your customer account.
4. Product Images and Presentation of Goods
Product images used in the online shop may partly originate from manufacturers, brand partners, suppliers, or official product databases and are used solely for non-binding illustrative purposes. They do not constitute an agreement on the quality of the goods nor any warranty or guarantee of specific characteristics.
Differences between the product images and the goods actually delivered may occur, in particular with regard to colour, material structure, workmanship, sole appearance, stitching, logos, patterns, textures or other design features. Such differences may result, among other things, from lighting conditions during photography, image editing, screen display settings, production-related batch variations, material properties, manufacturer updates, or other technical or product-specific factors.
Such deviations do not constitute a defect, provided that the delivered goods correspond to the stated model name, product description, size and the essential product characteristics and that usability is not impaired. Only the product description in the online shop is decisive for the contractually owed quality; images are non-binding in this respect.
5. Authenticity of Goods, Quality Control and Brand Notice
All products offered in our online shop are carefully checked for authenticity and quality prior to dispatch. In particular for sneakers, a multi-stage internal verification process is carried out, during which, among other things, materials, workmanship, model-specific details, stitching, shape, smell and other characteristic features of the respective model are inspected. Apparel items are checked accordingly as well.
The verification is performed to the best of our knowledge and based on customary industry criteria. Unless expressly stated otherwise, we have no contractual or economic relationship with the respective brand manufacturers. Brand names are used solely for the description and identification of the offered products.
6. Delivery Conditions
6.1 Payment
The following payment methods are available in our store:
Credit Card
Enter your credit card details during the ordering process. Your card will be charged immediately after placing the order.
PayPal
To pay the invoice amount via PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, log in with your credentials, and confirm the payment. The payment transaction will be processed immediately after placing the order.
Google Pay
To pay the invoice amount via Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have Google Pay activated, log in with your credentials, and confirm the payment. The payment transaction will be executed immediately after placing the order.
Apple Pay
To pay the invoice amount via Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have Apple Pay activated, log in with your credentials, and confirm the payment. The payment transaction will be executed immediately after placing the order. Further details are provided during the checkout process.
Shop Pay
To pay the invoice amount via Shop Pay, you must have a Shop Pay account. During the order process, you can save your payment and delivery information for faster processing of future orders. The payment transaction is executed immediately after placing the order. Shop Pay also offers the option of installment payments for certain orders. Further details are provided during the checkout process.
Union Pay
To pay the invoice amount via UnionPay, you must use a UnionPay-enabled credit or debit card authorized for international payments. The payment is made during the order process by entering your card details and confirming the payment. UnionPay enables quick and secure payment processing, particularly for customers from Asian markets. Further details are provided during the checkout process.
6.2 Shipping Costs and Import Duties
Domestic and European Union Deliveries: Shipping costs for deliveries within Germany and to other European Union member states are clearly displayed during the ordering process. Typically, no additional import duties or tariffs apply within the European Union.
Deliveries Outside the European Union: For international deliveries to countries outside the European Union, additional costs may apply, including:
Import Duties: Customs charges imposed by the destination country.
Taxes and Fees: For example, VAT or similar charges in the destination country.
These costs are the responsibility of the buyer and are collected directly by the relevant authorities in the destination country. Please check with your local customs office for potential additional charges before placing your order.
6.3 Delivery
Drop-off Location and Transfer of Risk: If the customer specifies an alternative drop-off location for delivery with the shipping provider (e.g., a specific location or delivery to a neighbor), the risk of accidental loss or deterioration of the goods transfers to the customer or recipient once the goods have been dropped off. We accept no liability for damage or loss occurring after the goods have been dropped off.
Combined Deliveries for Items with Different Delivery Times: If you order multiple items with varying delivery times in one order, we reserve the right to ship the order only when all items have arrived in our warehouse. If a partial delivery is desired, please contact us. Additional costs may apply for partial deliveries.
6.4 Delivery Times
Products marked with a delivery time are not in stock. You can recognise this by the specific delivery period displayed next to the size on the product page. Such products are ordered from a retailer specifically for the customer in order to ensure availability.
The stated delivery period refers to deliveries within Germany. For deliveries to other countries, especially outside the European Union, delivery times may differ. In such cases, we will inform you in due time about the expected delivery time.
6.5 Availability
Items explicitly marked in the online shop as ready for immediate dispatch or in stock are held in our own warehouse and are generally shipped shortly after receipt of payment.
Another part of our assortment, in particular limited sneaker releases, exclusive models or selected fashion items, is sourced only after an order has been placed, for example from authorised retailers, partners or marketplaces. In these cases, the extended delivery times stated on the product page apply.
As these may be limited or difficult-to-source products, in exceptional cases an item may become unavailable despite careful planning. If an item cannot be sourced as expected, we will inform you without undue delay and refund any payments already made. Information on availability and delivery times is provided to the best of our knowledge and is non-binding, especially for limited products.
6.6 Transfer of Risk
For Entrepreneurs: The risk of accidental loss or deterioration of the goods passes to the buyer upon delivery to the carrier, freight forwarder, or other person or institution designated to perform the shipment.
For Consumers: The risk of accidental loss or deterioration of the goods passes to the buyer only upon handover of the goods, even in the case of shipping purchases.
Handover is deemed equivalent if the buyer is in default of acceptance.
6.7 Retention of Title
The goods remain our property until full payment of all claims arising from the purchase contract has been made.
The customer is obliged to notify us immediately if third parties access the goods subject to retention of title (e.g., by seizure). The customer shall bear all costs required to remove such interference and to recover the goods.
The customer is also obliged to treat the goods with care and to protect them against damage, theft or loss.
6.8 Undeliverable Shipments
If a delivery cannot be delivered or accepted for reasons attributable to the customer and the goods are returned to the seller by the shipping provider, this does not constitute a withdrawal from the order. This includes, in particular, cases of an incorrect or incomplete delivery address, refusal of acceptance, failure to collect the shipment, or non-payment of customs duties, import charges or other costs required for acceptance of the delivery.
In such cases, the seller is entitled to deduct the actually incurred return shipping costs as well as any import charges, customs duties and other costs charged by the shipping provider in connection with the failed delivery or acceptance from the amount to be refunded.
In addition, a flat handling and storage fee of 5% of the value of the goods, up to a maximum of EUR 20.00, may be deducted from the refund amount. The customer remains entitled to prove that no damage, or significantly less damage, has occurred.
7. Right of Withdrawal
7.1 Right of withdrawal within the European Union
Consumers within the European Union have a statutory right of withdrawal. You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period begins on the day on which the consumer or a third party named by the consumer (who is not the carrier) takes possession of the goods. 7.2 Right of withdrawal outside the European Union
For deliveries to countries outside the European Union, we do not grant any voluntary right of withdrawal or return. Returns from non-EU countries are excluded.
This is due in particular to the significant logistical effort, customs requirements and economic risks associated with international return transport. Any statutory warranty rights in the event of defective goods remain unaffected.
7.3 Condition of returns
Our products may be tried on under normal conditions, i.e., indoors only on a clean, dry surface to avoid dirt or wear. A return is only possible if the goods are in a new, unworn condition without any signs of use.
For sneakers, special care must be taken to avoid creases or pressure marks in the material, which can be caused by extensive try-on or strong rolling of the foot. Such changes impair the “as new” condition and may affect the return handling.
A security tag or a circular “44” plastic seal may be attached to our products. If it is removed or damaged, this may be considered use beyond mere inspection and may result in a claim for compensation for diminished value. The statutory right of withdrawal remains unaffected. We therefore recommend leaving the security tag or the circular “44” plastic seal attached to the item until a final purchase decision has been made. This can also facilitate processing of the return.
7.4 Return Shipping Costs in Case of Withdrawal
In the event of withdrawal, the consumer pays the direct costs of returning the goods.
8. Warranty, Liability for Defects, and General Liability
8.1 Statutory Warranty
For all goods in our store, statutory warranty rights apply.
8.2 Liability for Defects
If the delivered goods are defective, the buyer is entitled to the statutory warranty rights. Consumers may choose between rectification (repair) or replacement delivery unless the chosen remedy would incur disproportionate costs.
Entrepreneurs must report obvious defects in writing immediately upon receipt of the goods. Otherwise, claims for defects are excluded.
8.3 General Liability
We are liable without limitation for intent and gross negligence as well as for damage resulting from injury to life, body or health.
In the event of a slightly negligent breach of essential contractual obligations (“cardinal obligations”), our liability is limited to the foreseeable damage typical for the contract. Cardinal obligations are obligations the fulfilment of which is essential for the proper performance of the contract and on the observance of which the customer may regularly rely.
Otherwise, liability for damage caused by slight negligence is excluded. Liability under the Product Liability Act as well as liability due to expressly assumed guarantees remain unaffected.
